Definitions<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1e967f5 elementor-widget elementor-widget-text-editor\" data-id=\"1e967f5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>When used in this Agreement, each of the following words and phrases shall have the meanings set out below:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e450945 elementor-widget elementor-widget-text-editor\" data-id=\"e450945\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ol class=\"c\"><li>\u201cAgreement\u201d means these Terms and Conditions, including related schedules, policies and other documents referenced herein as may be amended from time to time;<\/li><li>&#8220;Beneficiary\u201d means a business entity or individual authorized by you as the receiver of Payment Amount.<\/li><li>\u201cBusiness Days\u201d means Monday to Friday excluding public holidays in Malaysia;<\/li><li>\u201cTransaction Fee\u201d means the non-refundable flat percentage fee charged by jomSETTLE\u2122 to you for use of our Services and will include any other promotional transaction fee that you may be charged from time to time for the use of Services<\/li><li>\u201cPayment Amount\u201d refers to the aggregate Malaysian Ringgit value of a payment exclusive of Transaction fee, which shall be transferred to the Beneficiary.<\/li><li>\u201cCard\u201d- means an accepted Credit\/Debit Card\u201d used or to be used by you in relation to the Services and for debit card it includes only debit card issued by Visa and MasterCard and for credit cards it includes only the credit cards issued by MasterCard and Visa.<\/li><li>\u201cPayment\u201d means the successful act of fund transfer against the goods and services availed.<\/li><li>\u201cCard Charging Date&#8221; is the date on which your Card is charged to initiate the making of a Payment.<\/li><li>\u201cScheduled Payment&#8221; is a Payment which has been created on the platform with a future Card Charging Date.<\/li><li>\u201cServices\u201d means and includes all the products, facilities, services, features, technologies or functionalities provided by us on our Website or through any other means.<\/li><li>\u201cSite\u201d means the website located at www.jomSETTLE\u2122.com and all related webpages as well as any app (\u201cApplications\u201d) or any other media in an electronic form.<\/li><li>\u201cuser\u201d, \u201cyou\u201d or &#8220;your&#8221; \u201cclient\u201d means you and any other person (authorized by you) or any entity using the Services;<\/li><li>\u201cUser Account\u201d- means a user\u2019s account that is created by an individual consumer or business for accessing and using jomSETTLE\u2122 Services;<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3f80478 elementor-widget elementor-widget-spacer\" data-id=\"3f80478\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2630c1f elementor-widget elementor-widget-heading\" data-id=\"2630c1f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">4. jomSETTLE\u2122 Services<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4aa814a elementor-widget elementor-widget-text-editor\" data-id=\"4aa814a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>jomSETTLE\u2122 provides Services which enable Users to pay rent, salaries and invoices to a relevant Beneficiary which may be a landlord, employee and\/or supplier via credit card(s). jomSETTLE\u2122 charges users a Transaction Fee for use of the Services. Users may be located anywhere in the world. All they need is an account on the website to pay to their beneficiaries. Our Company is merely providing a service to facilitate the above mentioned transactions between yourself and your Beneficiary and we are not and do not hold ourselves out as a bank, remittance agent or payment systems or payment gateways and we do not offer banking, money remittance or payment system services as defined by the applicable laws or the law of Malaysia. Our Company is merely providing a platform and we act as per your instructions in providing all the Services.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2074809 elementor-widget elementor-widget-spacer\" data-id=\"2074809\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-353e1ab elementor-widget elementor-widget-heading\" data-id=\"353e1ab\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">5. Your Representations and Warranties<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-37f10ee elementor-widget elementor-widget-text-editor\" data-id=\"37f10ee\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>You represent and warrant to jomSETTLE\u2122 that:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6bfd834 elementor-widget elementor-widget-text-editor\" data-id=\"6bfd834\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<style>\nul.a {list-style-type: circle;}\nul.b {list-style-type: square;}\nol.c {list-style-type: upper-roman;}\nol.d {list-style-type: lower-alpha;}\n<\/style>\n<ol class=\"c\">\n \t<li>these Terms &amp; Conditions constitutes a legal, valid and binding obligation of yourself and\/or the entity you represent in using the Service;<\/li>\n \t<li>all the Payments made using the Service are lawful, valid and genuine and do not promote any Money Laundering or Terrorist Financing;<\/li>\n \t<li>in executing and giving effect to these Terms &amp; Conditions, you will not infringe any provision of any other document or agreement to which you are a party, nor any law or judgment\/order binding upon you;<\/li>\n \t<li>all information supplied to jomSETTLE\u2122 by you is, or at the time it is supplied will be, accurate in all material respects and you will not omit or withhold any information which would make such information inaccurate in any material respect<\/li>\n \t<li>you will provide to jomSETTLE\u2122 on request such information regarding your financial and business affairs and\/or identity, as jomSETTLE\u2122 may reasonably require;<\/li>\n \t<li>you will take all reasonable steps to obtain and provide to jomSETTLE\u2122 all information and documents relating to any or all Payments set up by you on the platform.<\/li>\n \t<li>jomSETTLE\u2122 relies on representations and warranties made by you. These representations and warranties and those contained elsewhere in these Terms &amp; Conditions are repeated in respect of each Payment.<\/li>\n \t<li>You have obtained the necessary permission from your Beneficiary to allow us to contact him\/her\/it to collect any necessary information from them for the purposes of us providing the Services to you (and your Beneficiary) and\/or for validating a Payment<\/li>\n<\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1138429 elementor-widget elementor-widget-spacer\" data-id=\"1138429\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fae8316 elementor-widget elementor-widget-heading\" data-id=\"fae8316\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">7. Geographies Covered<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-90a3d3f elementor-widget elementor-widget-text-editor\" data-id=\"90a3d3f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>jomSETTLE\u2122 currently based in Malaysia and jomSETTLE\u2122 users can make payments to their Beneficiaries having a bank account in Malaysia only. The transfers to Malaysian bank account shall be done in Malaysian Ringgit. Please note that our Company is not involved in cross border payments.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3fd4faa elementor-widget elementor-widget-spacer\" data-id=\"3fd4faa\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2be6b70 elementor-widget elementor-widget-heading\" data-id=\"2be6b70\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">8. Transfer of Funds to Beneficiary<\/p>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5776d17 elementor-widget elementor-widget-text-editor\" data-id=\"5776d17\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Once your card is charged it will take 4 (T+3) business days from the Card Charging Date for the funds to reach your Beneficiary. However, the funds transferred to your Beneficiary may fail because of a number of reasons including but not limited to invalid beneficiary account number, incorrect bank name, incorrect swift code, improper documentation etc. You agree not to hold jomSETTLE\u2122 responsible for any delay beyond 4 days in transferring the funds to your Beneficiary. jomSETTLE\u2122 has the absolute discretion to refuse\/stop the transfer of any Payment for reason\/reasons that may or may not be notified to a user.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c9c2435 elementor-widget elementor-widget-heading\" data-id=\"c9c2435\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">14.5.    Transaction Fee<\/p>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a644507 elementor-widget elementor-widget-text-editor\" data-id=\"a644507\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>When making a Payment using the Services, our company will charge you a non-refundable Transaction Fee. The Transaction fee is charged on a per transaction basis. This Transaction Fee is payable in addition to the Payment Amount.<\/p><p>Transaction Fees for immediately processed Payments are charged in real-time upon submission. Transaction Fees for Recurring Payments are determined at time of submission and will be charged on the Payment\u2019s Card Charging Date. If a Recurring Payment is edited prior to its Card Charging Date, the applicable Transaction Fee will be recalculated based on the presently defined rules which may result in a change in Transaction Fee.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-af89f58 elementor-widget elementor-widget-heading\" data-id=\"af89f58\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">14.6.    Changes in Transaction Fees<\/p>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6e21ccc elementor-widget elementor-widget-text-editor\" data-id=\"6e21ccc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Transaction Fees may change, depending upon factors including but not limited to the Card used, any applicable Promotions, and other variables both which may or may not be controlled by jomSETTLE\u2122. Fees are subject to change at any time without prior notice and are calculated in real time and presented to you during review of your Payment, prior to submission. Any promotion will have a subset of terms and conditions and the user will be entitled to the promotion only if they adhere to all the terms and conditions attached to a promo code.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-98677cb elementor-widget elementor-widget-heading\" data-id=\"98677cb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">14.7. Payment Dispute and Refund of Transaction fees<\/p>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c6c8b26 elementor-widget elementor-widget-text-editor\" data-id=\"c6c8b26\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>If your Payment is not processed or wrongly processed for any reason including but not limited to the following reasons:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2f3a06e elementor-widget elementor-widget-text-editor\" data-id=\"2f3a06e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ol class=\"d\"><li>Wrong account details of Beneficiary entered by you<\/li><li>Wrong amount entered by you<\/li><li>Duplicate entries created by you<\/li><li>Improper documentation provided by you etc.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8b5ac2c elementor-widget elementor-widget-text-editor\" data-id=\"8b5ac2c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>jomSETTLE\u2122 shall not be responsible for any delays in payments or incorrect transferring of the Payment Amount. jomSETTLE\u2122 may choose to assist the user out of goodwill in contacting the party that received the payment to request a refund to be issued to the user. However, jomSETTLE\u2122 shall not be liable to reimburse any Payment Amount or to reverse any transaction that has been made as a result of the user\u2019s error or negligence.<\/p><p>Upon completion of Payment, the user accepts and agrees that no refunds, cancellations or charge backs are permitted through the jomSETTLE\u2122 site. Additionally, the user accepts and agrees not to request a refund, cancellation or charge back of Transaction Fees from his\/her Card issuing bank, bank or any other person or jomSETTLE\u2122.<\/p><p>In the case that Payment should be refunded, cancelled or charged back by the user\u2019s Card issuing bank or any other person, the user is not entitled to the return\/refund of any associated jomSETTLE\u2122 Transaction Fees, irrespective of the reason for such refund, cancellation or charge back. The user is also responsible for the payment of any associated payment dispute and refund fees.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ff9ba6b elementor-widget elementor-widget-heading\" data-id=\"ff9ba6b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">14.8. No right to a refund from JomSETTLE\u2122<\/p>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-afd653b elementor-widget elementor-widget-text-editor\" data-id=\"afd653b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>We act as an intermediary for JomSETTLE\u2122 Service users, (including End Users, Guests, Payors and Payees) to transact and are not a party to any agreement to buy, sell or provide goods or services that are paid for using the JomSETTLE\u2122 Service. Any contract between JomSETTLE\u2122 users in respect of any goods or services provided by the Payee, or in respect of any payment obligation between Guests, Payors and Payees, is independent of these Terms and is entirely between the relevant Guests, Payors and Payees. You remain solely and fully responsible for the timely and complete fulfilment of all your obligations towards your Payee (whether under contract or at law).<\/p><p>Any interaction between you and a JomSETTLE\u2122 Service user, including any agreement entered into between you and another JomSETTLE\u2122 Service user, is a matter directly between you and them only. Other than our obligations set out in these Terms, we are not liable to you for any failure by any JomSETTLE\u2122 Service user to comply with these Terms or any other legal obligation. When you use the JomSETTLE\u2122 Service to make a payment you do not have any right to require us to provide you with a refund of the payment and you do not have any right to a refund of the JomSETTLE\u2122 Fee relating to the payment.<\/p><p>You may of course direct a refund request to the relevant Payee. If the Payee agrees to a refund, the Payee may pay the refund to your bank account directly or pay the refund to us. In that case, we will use our best efforts to apply the amount we receive from the Payee to your Payment Card. \u00a0\u00a0\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f94b695 elementor-widget elementor-widget-heading\" data-id=\"f94b695\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">14. 9 Card Delays and Non-Completion<\/p>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-746ae04 elementor-widget elementor-widget-text-editor\" data-id=\"746ae04\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Notwithstanding anything contained in these Terms and Conditions some Card Payments may take up at least 5 Business Days or such number of Business Days. Furthermore, completion of a Card payment is contingent on both the authorization of the Card Payment and acceptance of the Card. In the event that a Card payment is unable to be completed, we will attempt to notify you at least once using the contact information in your User Account. In the case of such delay or non-completion, your liability to the intended recipient of the Card Payment may be subject to penalties, late fees and interest charges assessed by such recipient, all of which remain your responsibility (and not us). If a Payment is not completed, you are not entitled to a return of any Transaction fees charged by us, irrespective of the reason for non-completion.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c063709 elementor-widget elementor-widget-heading\" data-id=\"c063709\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">14.10.    Payment Limits<\/p>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d24a90c elementor-widget elementor-widget-text-editor\" data-id=\"d24a90c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>We may, at our sole discretion, impose limits on the Payment Amount you can send through our Services. RM300 is the minimum payment and RM29,000 is the maximum payment limit per transaction.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-faac43d elementor-widget elementor-widget-spacer\" data-id=\"faac43d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f5406bb elementor-widget elementor-widget-heading\" data-id=\"f5406bb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">15. Acceptable Card<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-62d38cd elementor-widget elementor-widget-text-editor\" data-id=\"62d38cd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>jomSETTLE\u2122 platform supports Cards issued by Visa and MasterCard.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c033fea elementor-widget elementor-widget-spacer\" data-id=\"c033fea\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c4e2e0c elementor-widget elementor-widget-heading\" data-id=\"c4e2e0c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">16. Taxes<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b803df7 elementor-widget elementor-widget-text-editor\" data-id=\"b803df7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>It is your responsibility to determine what, if any, taxes apply to the Payments you make, and it is your responsibility to collect, report and remit the correct tax to the appropriate tax authority. Our company is not responsible for determining whether taxes apply to your Payment transaction, or for collecting, reporting or remitting any taxes arising from any Payment transaction.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-47d3807 elementor-widget elementor-widget-spacer\" data-id=\"47d3807\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-282e2fa elementor-widget elementor-widget-heading\" data-id=\"282e2fa\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">17. While we use reasonable efforts to keep the Site accessible, the Site may be unavailable from time to time for any reason including, without limitation, routine maintenance. You understand and acknowledge that due to circumstances both within and outside of our control Site access may be interrupted, suspended or terminated. The content and information on the Site and the Service, as well as the infrastructure used to provide both, and all materials therein or transferred thereby and all intellectual property rights related thereto, are the exclusive property of our company and its licensors and other partners where relevant. Limitation of Liability<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-39687a6 elementor-widget elementor-widget-text-editor\" data-id=\"39687a6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>YOU AGREE THAT OUR COMPANY IS MERELY PROVIDING A PLATFORM AND THEREFORE, YOU FURTHER ACKNOWLEDGE AND AGREE THAT WE ARE NOT RESPONSIBLE FOR (A) ANY BREACHES, FRAUD, DISHONESTY, MISFEASANCE OR FAILURE TO DISCHARGE ANY DUTY OF CARE OR OBLIGATIONS ON THE PART OF ANY THIRD PARTIES CONTRACTING WITH YOU ON THE SITE AND (B) ANY CLAIMS FOR INJURIES, ILLNESSES, DAMAGES, LIABILITIES AND COSTS (\u201cLIABILITIES\u201d) THAT YOU MAY SUFFER, DIRECTLY OR INDIRECTLY, IN FULL OR IN PART AS A RESULT OF THE ACTS OR OMISSIONS OF SUCH PAYORS OR THIRD PARTIES OR ANYTHING IN RELATION TO ANY CONTRACT OR TRANSACTIONS YOU MAY ENTER INTO WITH SUCH PAYORS OR THIRD PARTIES, WHETHER RELATED TO THE USE OF THE SERVICE AND\/OR THE SITE. 10.2 GENERAL LIMITATION OF LIABILITY. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE TO AND HEREBY WAIVE AND RELEASE OUR COMPANY, ITS SUBSIDIARIES, AFFILIATES PARTNERS, OFFICERS, DIRECTORS, STAFF MEMBERS, STOCKHOLDERS AND AGENTS FROM ANY LIABILITIES ARISING FROM OR RELATED TO (I) ANY BREACHES, MISFEASANCE OR FAILURE TO DISCHARGE ANY DUTY OF CARE OR OBLIGATIONS ON THE PART OF ANY LANDLORDS OR THIRD PARTIES CONTRACTING WITH YOU ON THE SITE AND\/OR (II) ANY INDIRECT, SPECIAL, PUNITIVE, CONSEQUENTIAL, (INCLUDING, LOST PROFITS OR LOST DATA COLLECTED THROUGH THE SERVICE), OR INCIDENTAL DAMAGES, WHETHER BASED ON A CLAIM OR ACTION OF CONTRACT, WARRANTY, NEGLIGENCE, STRICT LIABILITY, OR OTHER TORT, BREACH OF ANY STATUTORY DUTY, INDEMNITY OR CONTRIBUTION, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Users may be located anywhere in the world. All they need is an account on the website to pay to their beneficiaries. Our Company is merely providing a service to facilitate the above mentioned transactions between yourself and your Beneficiary and we are not and do not hold ourselves out as a bank, remittance agent or payment systems or payment gateways and we do not offer banking, money remittance or payment system services as defined by the applicable laws or the law of Malaysia. These representations and warranties and those contained elsewhere in these Terms &amp; Conditions are repeated in respect of each Payment.<\/li>\n \t<li>You have obtained the necessary permission from your Beneficiary to allow us to contact him\/her\/it to collect any necessary information from them for the purposes of us providing the Services to you (and your Beneficiary) and\/or for validating a Payment<\/li>\n<\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c9534c1 elementor-widget elementor-widget-spacer\" data-id=\"c9534c1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b4078b4 elementor-widget elementor-widget-heading\" data-id=\"b4078b4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">7. The transfers to Malaysian bank account shall be done in Malaysian Ringgit. You may not close your account to evade an investigation. jomSETTLE\u2122 also reserves the right to close your account at any time with or without notice to you.<\/p><p>Any Payments processed prior to account closure will be completed, all Scheduled Payments whose Card Charging Date has not yet passed at the time of account closure will be considered cancelled.<\/p><p>jomSETTLE\u2122 may retain data associated to your usage of the Services in accordance with applicable regulatory and compliance obligations.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e61500d elementor-widget elementor-widget-spacer\" data-id=\"e61500d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4899864 elementor-widget elementor-widget-heading\" data-id=\"4899864\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">14. Recurring Scheduled Payment Reminder<\/p>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-20ba7c2 elementor-widget elementor-widget-text-editor\" data-id=\"20ba7c2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Recurring Scheduled Payments Reminder is a facility that jomSETTLE\u2122 will send an email reminder for any Payment has been set to the users.\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6e18e48 elementor-widget elementor-widget-heading\" data-id=\"6e18e48\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">14.3.    Payment Processing<\/p>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-eac0214 elementor-widget elementor-widget-text-editor\" data-id=\"eac0214\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Payments submitted for immediate processing will require successful debiting of the Card at time of payment creation. If a Card is not charged, jomSETTLE\u2122 will be not be able to transfer the funds to your Beneficiary. You agree not to hold jomSETTLE\u2122 responsible for any delay as a result of failure in charging of card on a Card Charging Date. After each Payment is processed you are provided with a unique receipt number in relation to your Payment.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6d758dd elementor-widget elementor-widget-heading\" data-id=\"6d758dd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">14.4.    Transfer of Funds to Beneficiary<\/p>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c5145c8 elementor-widget elementor-widget-text-editor\" data-id=\"c5145c8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Once your card is charged it will take 4 (T+3) business days from the Card Charging Date for the funds to reach your Beneficiary. However, the funds transferred to your Beneficiary may fail because of a number of reasons including but not limited to invalid beneficiary account number, incorrect bank name, incorrect swift code, improper documentation etc. You agree not to hold jomSETTLE\u2122 responsible for any delay beyond 4 days in transferring the funds to your Beneficiary. jomSETTLE\u2122 has the absolute discretion to refuse\/stop the transfer of any Payment for reason\/reasons that may or may not be notified to a user.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f7e422b elementor-widget elementor-widget-heading\" data-id=\"f7e422b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">14.5.    Transaction Fee<\/p>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4d63e8f elementor-widget elementor-widget-text-editor\" data-id=\"4d63e8f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>When making a Payment using the Services, our company will charge you a non-refundable Transaction Fee. The Transaction fee is charged on a per transaction basis. This Transaction Fee is payable in addition to the Payment Amount.<\/p><p>Transaction Fees for immediately processed Payments are charged in real-time upon submission. Transaction Fees for Recurring Payments are determined at time of submission and will be charged on the Payment\u2019s Card Charging Date. If a Recurring Payment is edited prior to its Card Charging Date, the applicable Transaction Fee will be recalculated based on the presently defined rules which may result in a change in Transaction Fee.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9ed6064 elementor-widget elementor-widget-heading\" data-id=\"9ed6064\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">14.6.    Changes in Transaction Fees<\/p>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-20594be elementor-widget elementor-widget-text-editor\" data-id=\"20594be\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Transaction Fees may change, depending upon factors including but not limited to the Card used, any applicable Promotions, and other variables both which may or may not be controlled by jomSETTLE\u2122. Fees are subject to change at any time without prior notice and are calculated in real time and presented to you during review of your Payment, prior to submission. Any promotion will have a subset of terms and conditions and the user will be entitled to the promotion only if they adhere to all the terms and conditions attached to a promo code.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-96a89e5 elementor-widget elementor-widget-heading\" data-id=\"96a89e5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">14.7. Payment Dispute and Refund of Transaction fees<\/p>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7732678 elementor-widget elementor-widget-text-editor\" data-id=\"7732678\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>If your Payment is not processed or wrongly processed for any reason including but not limited to the following reasons:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9cf3a0f elementor-widget elementor-widget-text-editor\" data-id=\"9cf3a0f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ol class=\"d\"><li>Wrong account details of Beneficiary entered by you<\/li><li>Wrong amount entered by you<\/li><li>Duplicate entries created by you<\/li><li>Improper documentation provided by you etc.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2545299 elementor-widget elementor-widget-text-editor\" data-id=\"2545299\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>jomSETTLE\u2122 shall not be responsible for any delays in payments or incorrect transferring of the Payment Amount. jomSETTLE\u2122 may choose to assist the user out of goodwill in contacting the party that received the payment to request a refund to be issued to the user. However, jomSETTLE\u2122 shall not be liable to reimburse any Payment Amount or to reverse any transaction that has been made as a result of the user\u2019s error or negligence.<\/p><p>Upon completion of Payment, the user accepts and agrees that no refunds, cancellations or charge backs are permitted through the jomSETTLE\u2122 site. Additionally, the user accepts and agrees not to request a refund, cancellation or charge back of Transaction Fees from his\/her Card issuing bank, bank or any other person or jomSETTLE\u2122.<\/p><p>In the case that Payment should be refunded, cancelled or charged back by the user\u2019s Card issuing bank or any other person, the user is not entitled to the return\/refund of any associated jomSETTLE\u2122 Transaction Fees, irrespective of the reason for such refund, cancellation or charge back. The user is also responsible for the payment of any associated payment dispute and refund fees.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2b9d6f2 elementor-widget elementor-widget-heading\" data-id=\"2b9d6f2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">14.8. No right to a refund from JomSETTLE\u2122<\/p>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d7df6e6 elementor-widget elementor-widget-text-editor\" data-id=\"d7df6e6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>We act as an intermediary for JomSETTLE\u2122 Service users, (including End Users, Guests, Payors and Payees) to transact and are not a party to any agreement to buy, sell or provide goods or services that are paid for using the JomSETTLE\u2122 Service. Any contract between JomSETTLE\u2122 users in respect of any goods or services provided by the Payee, or in respect of any payment obligation between Guests, Payors and Payees, is independent of these Terms and is entirely between the relevant Guests, Payors and Payees. You remain solely and fully responsible for the timely and complete fulfilment of all your obligations towards your Payee (whether under contract or at law).<\/p><p>Any interaction between you and a JomSETTLE\u2122 Service user, including any agreement entered into between you and another JomSETTLE\u2122 Service user, is a matter directly between you and them only. Other than our obligations set out in these Terms, we are not liable to you for any failure by any JomSETTLE\u2122 Service user to comply with these Terms or any other legal obligation. When you use the JomSETTLE\u2122 Service to make a payment you do not have any right to require us to provide you with a refund of the payment and you do not have any right to a refund of the JomSETTLE\u2122 Fee relating to the payment.<\/p><p>You may of course direct a refund request to the relevant Payee. If the Payee agrees to a refund, the Payee may pay the refund to your bank account directly or pay the refund to us. In that case, we will use our best efforts to apply the amount we receive from the Payee to your Payment Card. \u00a0\u00a0\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-27cdeaf elementor-widget elementor-widget-heading\" data-id=\"27cdeaf\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">14.9. Card Delays and Non-Completion<\/p>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a31ddaa elementor-widget elementor-widget-text-editor\" data-id=\"a31ddaa\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Notwithstanding anything contained in these Terms and Conditions some Card Payments may take up at least 5 Business Days or such number of Business Days. Furthermore, completion of a Card payment is contingent on both the authorization of the Card Payment and acceptance of the Card. In the event that a Card payment is unable to be completed, we will attempt to notify you at least once using the contact information in your User Account.
